释义	法律分析：诽谤和造谣构成犯罪。故意捏造并散布某些虚构的事实，足以破坏他人名誉，损害他人人格，情节严重的行为。即诽谤他人的内容必须是捏造和虚构的。即要求“被散布的内容必须不是客观存在”，如果散布的内容是客观存在的事实，即使有损于他人的人格，也不构成本罪，而是名誉侵权行为。要有散布捏造事实的行为。法律依据：《中华人民共和国刑法》第二百四十六条关于诽谤罪的规定，根据该条规定，以暴力或者其他方法捏造事实诽谤他人，情节严重的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。
