释义	法律分析：将他人遗忘物非法占为己有，数额较大，且拒不交出的，按照侵占罪予以处罚。如果拒不交出他人财物，应以侵占罪提起刑事诉讼。但不存在拒不交出捡拾物的情节，不应作侵占罪对待，不能认定为犯罪，不能以刑法惩戒，其行为只能由民事法律规范予以调整。法律依据：《中华人民共和国民法典》第三百一十四条拾得遗失物，应当返还权利人。拾得人应当及时通知权利人领取，或者送交公安等有关部门。
