释义	法律分析：法律规定实习生一般情况下不需要签合同，凡是中国境内的企业与劳动者建立劳动关系，都应当按照《劳动合同法》的规定，自用工之日起一个月内订立书面的劳动合同。在校学生不是广义《劳动法》中合法的劳动者主体，其提供劳动，双方形成的是劳务关系而不是劳动关系。对劳务关系的建立形式我国目前尚无明确的法律规定，所以在此期间公司可以不签订书面合同。
