释义	专利犯罪立案标准：1、违法所得数额在10万元以上的；2、给专利权人造成直接经济损失数额在50万元以上的；3、虽未达到上述数额标准，但因假冒他人专利，受过行政处罚2次以上，又假冒他人专利；4、造成恶劣影响的。【法律依据】《刑法》第二百一十六条假冒他人专利，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。第二百二十条单位犯本节第二百一十三条至第二百一十九条规定之罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照本节各该条的规定处罚。
