释义	法律分析: 在正常使用条件下，屋面防水工程、有防水要求的卫生间、房间和外墙面的防渗漏，最低保修期限是5年。也就是说，如果购房未满5年，出现墙体发霉等情况可以主张由开发商承担责任；如果新房过了五年的保修期，房屋质量防水的工程应该由物业负责。但是，因为使用不当或者第三方造成的质量缺陷或不可抗力造成的质量缺陷的除外。法律依据: 《房屋建筑工程质量保修办法》第四条房屋建筑工程在保修范围和保修期限内出现质量缺陷，施工单位应当履行保修义务。
