释义	【法律意见】若未办理入职手续，可以直接申请离职。若已经办理了入职手续，处于试用期，可提前三天提出离职。如果刚入职第二天不想就职，可在提出离职的三天内请假，或与用人单位协商直接办理离职，若用人单位同意可直接离职。【法律依据】《中华人民共和国劳动合同法》第三十七条劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
