释义	法律主观：不上夜班被辞退，分以下情形赔偿： 1、夜班属于用人单位正常安排的，符合法律规定的，在劳动合同中有约定的工时，不上夜班属于严重违反用人单位规章制度被辞退的，用人单位不需要赔偿。 2、夜班属于违法安排劳动者工作的，劳动者有权拒绝，用人单位为此辞退的，属于违法辞退，不需要支付经济补偿金，但应当继续履行劳动合同或者按经济补偿标准的两倍支付赔偿金。经济补偿按劳动者在本单位工作的年限，每满一年支付一个月工资的标准向劳动者支付。月工资是指劳动者在劳动合同解除或者终止前十二个月的平均工资。
