释义	外国人在领域外对我国国家公民实施犯罪的，按照我国刑法在法定最低刑3年以上有期徒刑的，可以适用我国法律。但是按照犯罪地的法律不受处罚的除外。这是刑法的保护原则。法律依据：《中华人民共和国刑法》第九条对于中华人民共和国缔结或者参加的国际条约所规定的罪行，中华人民共和国在所承担条约义务的范围内行使刑事管辖权的，适用本法。第十一条外交特权和豁免权的外国人的刑事责任，通过外交途径解决。
