高温作业中暑职工是否能申请工伤

法律分析:高温作业中中暑的,被医疗机构诊断为职业性中暑的属于工伤,职工依法可以享受工伤保险待遇。根据我国有关法律的规定,职工因为高温作业或者在高温的天气下作业的,一经诊断为职业性中暑的,属于由物理因素导致的职业病,属于职业病,职工可以申请工伤。职业性中暑的职工应当到有职业病诊断资质的医疗机构进行诊断,并在规定时间内申请工伤认定。
法律依据:《防暑降温措施管理办法》
第十九条规定:劳动者因高温作业或者高温天气作业引起中暑,经诊断为职业病的,享受工伤保险待遇。
