已婚长期同居算不算重婚罪

释义

法律主观：

长期同居的行为是不一定会构成重婚的。重婚是指有配偶而重婚的，或者明知他人有配偶而与之结婚的行为。那么以夫妻名义而同居的就可以算作重婚行为，如果不是以夫妻名义长期同居的，不算重婚行为。

法律客观：

《中华人民共和国刑法》第三条法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
