释义	法律分析：申诉是指当事人及其法定代理人对已经发生法律效力的判决、裁定、调解，认为确有错误，向同级或上一级人民检察院提出的重新处理的一种请求。申诉可以向人民检察院申请。法律依据：《中华人民共和国刑事诉讼法》第四十九条　辩护人、诉讼代理人认为公安机关、人民检察院、人民法院及其工作人员阻碍其依法行使诉讼权利的，有权向同级或者上一级人民检察院申诉或者控告。人民检察院对申诉或者控告应当及时进行审查，情况属实的，通知有关机关予以纠正。
