释义	法律分析：警察在执法的过程中出现冤假错案的,在对被害者进行赔偿,并且追究当事警察的法律责任,构成犯罪的追究刑事责任。法律依据：《中华人民共和国国家赔偿法》第九条赔偿义务机关有本法第三条、第四条规定情形之一的，应当给予赔偿。赔偿请求人要求赔偿应当先向赔偿义务机关提出，也可以在申请行政复议或者提起行政诉讼时一并提出。第十条赔偿请求人可以向共同赔偿义务机关中的任何一个赔偿义务机关要求赔偿，该赔偿义务机关应当先予赔偿。
