释义	法律分析：在刑法理论中，有一种以不作为形式构成的犯罪。“不作为”是指在能够实施行为下未实施的情况。“不作为”需要具备以下三个条件：1、行为人负有行为义务，这是前提；2、有履行义务的可能性，但未履行；3、行为人未履行从而导致危害发生。如果满足以上条件，但是却“见死不救”，是由可能构成刑事犯罪的。法律依据：《中华人民共和国刑法》第二百三十二条故意杀人的，处死刑、无期徒刑或者十年以上有期徒刑；情节较轻的，处三年以上十年以下有期徒刑。
