释义	开设赌场罪是指客观上是否具有聚众赌博、开设赌场、以赌博为业的行为。一旦赌场开始正式营业，并有人实际使用，就成立本罪既遂，与开设者是否实际获得利润无关紧要。开设赌场的人自己参与赌博，并与赌博为业的，可以考虑以本罪和赌博罪并罚。主要方式有：一是以营利为目的，以行为人为中心，在行为人支配下设立、承包、租赁专门用于赌博的场所。提供赌博用具让他人赌博的，其场所公开与否并不影响犯罪构成。二是以营利为目的，在计算机网络上建立赌博网站，或者为赌博网站担任代理，接受投注的。
