释义	法律分析：土地房屋用途变更必须向规划管理部门和土地管理部门申请，补办批准手续。但有的单位在建设时擅自改变土地房屋用途或变更规划设计，至今未能补办相关手续，致使权证不能办理，例如市政府用地批文明确批复该单位土地用途全部为工业用途，但单位或是全部或是部分建造为住宅用房，还有的单位土地用途市政府批复为住宅，单位建设时却改变规划部门设计批复，底层改作商场之用。法律依据：《中华人民共和国土地管理法》第四十三条任何单位和个人进行建设，需要使用土地的，必须依法申请使用国有土地。
