释义	法律分析：医师在注册医疗机构外另辟地方行医，或者执业医师辞职后、离职后、退休后在任一地方行医的，即使没有取得《医疗机构执业许可证》，也不能再以非法行医罪追究其刑事责任。所以私设诊所是违法的，但不是非法行医的行为。非法行医罪，是指未取得医生执业资格的人以营利为目的的非法行医，为他人治病，情节严重的行为。情节严重，一般指非法行医，屡教不改的；骗取大量钱财的；损害就诊人身体健康的等等。法律依据：《医疗机构管理条例》第二十四条任何单位或者个人，未取得医疗执业许可证。不得展开诊疗活动。
