释义	法律分析: 网络跟帖不构成诽谤罪，如果跟帖者不知道原贴是在恶意诽谤他人，跟帖是不用承担刑事责任的，但若是明知诽谤还要跟帖，可能会成为诽谤者的共犯。需要注意的是，同一诽谤信息实际被点击、浏览次数达到五千次以上，或者被转发次数达到五百次以上的，即为侮辱诽谤罪的“情节严重”。《中华人民共和国刑法》第二百四十六条以暴力或者其他方法公然侮辱他人或者捏造事实诽谤他人，情节严重的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。
