释义	依据我国相关法律的规章，行政拘捕如果是被冤枉的，当事人对行政拘捕决定不服的，是可以申请复议、提起行政诉讼。法律依据：《中华人民共和国治安管理处罚法》第一百零七条被处罚人不服行政拘捕处罚决定，申请行政复议、提起行政诉讼的，可以向公安机关提出暂缓执行行政拘捕的申请。公安机关认为暂缓执行行政拘捕不致发生社会危险的，由被处罚人或者其近亲属提出符合本法第一百零八条规章条件的担保人，或者按每日行政拘捕二百元的标准交纳保证金，行政拘捕的处罚决定暂缓执行。
