被拍到的违章扣分扣车主的还是驾驶人的 -交通违章

法律分析：
交通违章行为，被交警当场开罚单的情况下，扣分是扣当事人(驾驶员)驾驶证的分。被监控探头拍摄的情况下，有当事人前往交警大队确认违章行为的，就扣当事人的;没有人认可的违章行为，车管所会以阻止车辆年检的方式，要求车主处理完毕违章行为之后再办理车辆的年检。
法律依据：
《中华人民共和国道路交通安全法实施条例》 第二十四条 机动车驾驶人在一个记分周期内记分未达到12分，所处罚款已经缴纳的，记分予以清除;记分虽未达到12分，但尚有罚款未缴纳的，记分转入下一记分周期。
