释义	法律分析：女职工在休产假期间，用人单位不能予以辞退，但是职工可以解除劳动合同，只需要提前一个月以书面的形式通知用人单位就可以解除劳动关系。法律依据：《女职工劳动保护规定》第五条用人单位不得因女职工怀孕、生育、哺乳降低其工资、予以辞退、与其解除劳动或者聘用合同。《中华人民共和国劳动合同法》第三十七条劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
