暑假工不签劳动合同是不合法的。暑假工劳动合同协议是属于劳动合同的一种。只要劳动协议中具有符合《劳动合同法》规定的相关条款,也是可以的。在劳动仲裁的时候,劳动协议的效用可以等同于劳动合同。
