嫖娼不一定会拘留，具体如下：
1、嫖娼行为可能被处以罚款或者拘留，并非一定会被拘留，最高处罚为罚款5000元，拘留15日。嫖娼不构成犯罪，是违法行为，一般只是拘留或者是罚款，情节较轻的教育一下也是有可能的；
2、如果是已经谈妥了价格并且付了金钱等财物，但是还未发生性关系的。第一次进行卖淫嫖娼，表示悔改或是有其他的特殊原因，其他较轻情节的情形。
法律依据：《中华人民共和国治安管理处罚法》第六十六条
卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款；情节较轻的，处五日以下拘留或者五百元以下罚款。
在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
第七十四条
旅馆业、饮食服务业、文化娱乐业、出租汽车业等单位的人员，在公安机关查处吸毒、赌博、卖淫、嫖娼活动时，为违法犯罪行为人通风报信的，处十日以上十五日以下拘留。
《中华人民共和国刑法》第三百六十二条
【包庇罪】旅馆业、饮食服务业、文化娱乐业、出租汽车业等单位的人员，在公安机关查处卖淫、嫖娼活动时，为违法犯罪分子通风报信，情节严重的，依照本法第三百一十条的规定定罪处罚。
