问题	任意撤销权的行使步骤
释义	从理论上讲，任意撤销权的行使方式因其“任意性”而有更多的选择，既可采取明示方式也可采取默示方式，还可以通过法院或者仲裁机构行使。但是，为了维护赠与合同的严肃性，应对默示方式进行限定性适用，例如，对于到期未交付赠与物的行为，不能当然推定其为撤销的行为；对于交付期限届至之前赠与人有偿转让的行为则不能简单地认定为撤销或非撤销的行为，关键看赠与人是否具备行使法定撤销权的条件，如果具备，则可推定其行使的是撤销权，如果不具备，则不能认定为撤销的行为，而应认定为预期违约行为。
