法律分析:
房产过户是指通过转让、买卖、赠予、继承遗产等方式获得房产，去房屋权属登记中心办理的房屋产权变更手续。即产权转移从甲方转移到乙方的全过程。房产过户有几种不同的情形，有继承的房产过户、赠与的房产过户、二手房过户等。
1、房产证过户不经过房地产中介的话，须把合同的条款和违约条款写清楚，签合同时须卖方房产证上面名字的当事人在场(如果是已婚得话，需要夫妻双方在场及签字，哪怕房产证上面只有一个人的名字)。
2、申请材料准备好后，须到房产局，填写一些表格和一个存量合同，存量合同上面的金额一定要和签订合同上面的金额一样。
3、房产过户的申请材料都交给房产局后，房产局会给予一个回执单，按照回执单上面说明的日期去缴纳税金，一般需要十五个工作日左右。
4、房产过户税金缴纳完毕后便可拿到房产证。
法律依据:
《不动产登记暂行条例》 第十四条 因买卖、设定抵押权等申请不动产登记的，应当由当事人双方共同申请。
属于下列情形之一的，可以由当事人单方申请：
(一)尚未登记的不动产首次申请登记的;
(二)继承、接受遗赠取得不动产权利的;
(三)人民法院、仲裁委员会生效的法律文书或者人民政府生效的决定等设立、变更、转让、消灭不动产权利的;
(四)权利人姓名、名称或者自然状况发生变化，申请变更登记的;
(五)不动产灭失或者权利人放弃不动产权利，申请注销登记的;
(六)申请更正登记或者异议登记的;
(七)法律、行政法规规定可以由当事人单方申请的其他情形。
