辞退返聘人员补偿 |

返聘人员辞退没有补偿。这种是劳务关系，不属于《劳动法》范畴。
劳务关系解除时经济补偿问题劳动关系中，除法定情形，用人单位与劳动者解除劳动关系时，应当给予劳动者一定经济补偿。
返聘人员与聘用单位间存在的劳务关系则不存在经济补偿的规定。基于此，聘用单位与返聘人员间解除劳务关系时，不应当再享有经济补偿。
退休返聘是指用人单位中的受雇佣者已经到达或超过法定退休年龄，从用人单位退休，再通过与原用人单位或者其他用人单位订立合同契约继续作为人力资源存续的行为或状态。包括：受雇佣者到达法定离退休年龄，在原工作岗位延长一定的工作时间;受雇者离退休后被原用人单位应聘回原单位从事同种或不同种工作;受雇者离退休后在劳务市场重新进行择业，到原用人单位之外的单位工作的情况。您清楚了吗？

《中华人民共和国劳动法》
第二十六条 有下列情形之一的，用人单位可以解除劳动合同，但是应当提前三十日以书面形式通知劳动者本人：（一）劳动者患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由用人单位另行安排的工作的；（二）劳动者不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的；（三）劳动合同订立时所依据的客观情况发生重大变化，致使原劳动合同无法履行，经当事人协商不能就变更劳动合同达成协议的。第四十七条 用人单位根据本单位的生产经营特点和经济效益，依法自主确定本单位的工资分配方式和工资水平。
