释义	法律分析：根据我国相关法律规定，行为人主观上与性服务者就卖淫、嫖娼行为以协商一致，具体表现为以及商定好价钱或者以及给付了相应的嫖资，嫖资可以是金钱，也可以是其他财务，客观上以及着手实施了性行为。在司法实践中，如果双方已经发生了性行为，但尚未给付嫖资的，也以卖淫嫖娼论处。法律依据：《中华人民共和国治安管理处罚法》第六十六条卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
