释义	法律分析：定罪不捕，是涉嫌犯罪但没有逮捕必要或者有法定不应当逮捕的情形。不捕决定作出后，犯罪嫌疑人就会被释放，公安机关会采取其他非限制人身自由的强制措施，如取保候审、监视居住。法律依据：《中华人民共和国刑事诉讼法》第八十五条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
