现役军人犯法,派出所是可以抓的,但是抓了后会移交其所属部队,由所属部队的军事法庭审理及判决。
法律依据：
《公安机关办理刑事案件程序规定》 第二十二条 对管辖不明确或者有争议的刑事案件，可以由有关公安机关协商。协商不成的，由共同的上级公安机关指定管辖。对情况特殊的刑事案件，可以由共同的上级公安机关指定管辖。
