释义	主合同无效，担保合同作为主合同的从合同，相应无效时，如果担保人不存在过错则不承担赔偿责任，反之在债务人不能清偿部分的三分之一范围内承担赔偿责任。法律依据《民法典》第三百八十八条，担保合同被确认无效后，债务人、担保人、债权人有过错的，应当根据其过错各自承担相应的民事责任。
