释义	法律分析：同居并不一定是重婚。. 当事人一方或者双方己存在有效的婚姻关系。. 如果双方之间均没有婚姻关系的存在，是未婚、离婚或丧偶的人，不能构成重婚。. 一方或双方虽有婚姻关系，但其婚姻己被宣告无效或被撤销，亦不能构成重婚。. 对于无效婚姻或可撤销婚姻的当事人，在其婚姻未经法定程序宣告无效或撤销之前，仍属于有配偶的人，若与他人结婚，构成重婚。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
