释义	法律分析: 现在是实行案件终身责任制了，不管是公安还是检察院还是法院，哪一个环节出问题就由哪一个部门承担责任，再由具体的责任人来承担。法律依据: 《中华人民共和国国家赔偿法》第三十一条赔偿义务机关赔偿后，应当向有下列情形之一的工作人员追偿部分或者全部赔偿费用：（一）有本法第十七条第四项、第五项规定情形的；（二）在处理案件中有贪污受贿，徇私舞弊，枉法裁判行为的。对有前款规定情形的责任人员，有关机关应当依法给予处分；构成犯罪的，应当依法追究刑事责任。
