释义	法律分析：最低承担刑事责任年龄为12周岁。但对于12周岁的人仅对故意杀人、故意伤害这两种罪承担刑事责任，且要求伤害结果是致人死亡或致人重伤或严重残疾，情节恶劣，还要经过最高人民检察院的追诉，才承担刑事责任。若行为人都不符合这几个条件，则不承担刑事责任。根据我国法律的规定，已满16周岁，应当承担刑事责任。法律依据：《中华人民共和国刑法》第十七条已满十二周岁不满十四周岁的人，犯故意杀人、故意伤害罪，致人死亡，情节恶劣的，经最高人民检察院核准，应当负刑事责任。
