法律主观：

刑法的罪刑法定意思：我国及其他世界各国刑法规定的一个基本原则之一，对于什么是犯罪、什么不是犯罪，对于犯罪怎样进行刑事处罚，必须以法律的形式进行事先的明文规定，禁止不成文的罪刑法定和事后的罪刑法定，禁止不利于行为人的溯及既往。

法律客观：

《刑法》第一条为了惩罚犯罪，保护人民，根据宪法，结合我国同犯罪作斗争的具体经验及实际情况，制定本法。第三条法律明文规定为犯罪行为的，依照法律定罪处刑；法律没有明文规定为犯罪行为的，不得定罪处刑。
