我国民法对胎儿的保护实行 法律问题

法律分析:
关于胎儿利益保护，存在总括的保护主义、个别的保护主义以及绝对主义三种不同立法例，我国现行立法采绝对主义，不符合胎儿利益保护的需要，应采总括的保护主义。
法律依据:
《中华人民共和国民法典》 第十六条 涉及遗产继承、接受赠与等胎儿利益保护的，胎儿视为具有民事权利能力。但是胎儿娩出时为死体的，其民事权利能力自始不存在。
