不办离职手续算辞职吗
释义
法律分析：不算，自动离职是指劳动者终止劳动关系时不履行解除手续，擅自出走离岗，或者解除手续没有办理完毕而离开单位。用人单位对擅自离职的职工可按旷工处理，给予除名。按照国家规定，自动离职的劳动者不享受任何待遇。
法律依据：《中华人民共和国劳动法》 第三十一条 劳动者解除劳动合同，应当提前三十日以书面形式通知用人单位。
