释义	法律分析：算立案。因为法律规定原告撤诉的离婚案件，没有新情况、新理由，六个月内又起诉的，比照判决不准离婚和调解和好的离婚案件的处理，人民法院不予受理。法律依据：《最高人民法院关于适用《中人民共和国民事诉讼法》若干问题的解释》第二百一十四条当事人撤诉或者人民法院按撤诉处理后，当事人又以同一诉讼请求再次起诉的，人民法院应予受理。因此，一般情况下，撤诉后又起诉的没有时间间隔限制。但离婚案件比较特殊，没有新情况新理由的，要求间隔六个月才能再次起诉。
