释义	法律分析：可以去备案，但是不是必须备案。用人单位与劳动者签订的书面劳动合同，双方签字盖章后生效，未到劳动局备案不影响劳动合同的生效。如果用人单位需要给劳动者缴纳社会保险，一般需要到劳动局先进行劳动合同备案，如果给劳动者办理失业金领取手续，需要到劳动局办理劳动合同解除手续。法律依据：《中华人民共和国劳动合同法》第十六条劳动合同由用人单位与劳动者协商一致，并经用人单位与劳动者在劳动合同文本上签字或者盖章生效。劳动合同文本由用人单位和劳动者各执一份。
