释义	重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。所谓有配偶，是指男人有妻、女人有夫，而且这种夫妻关系未经法律程序解除尚在存续的。重婚的形式包括法律上的重婚和事实上的重婚。法律上的重婚即前一婚姻未解除，又与他人办理结婚登记手续而构成的重婚。事实上的重婚，即前一婚姻未解除，又与他人以夫妻名义共同生活，虽未办理结婚登记手续，但事实上已构成重婚。【本文关联的相关法律依据】《刑法》第二百五十八条，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
