释义	法律分析: 公司注销了，也就不存在公司法人，所以无法起诉公司法人。当事人可以起诉公司的股东维权。公司被注销后，如未进行清算或者破产的，以该公司的股东、发起人或者出资人作为当事人;公司经过清算或者破产程序的，公司债务视为处理完毕。如有未了结的债务，应以从公司取得清算资产的股东为诉讼主体。法律依据: 《最高法院关于民事诉讼法的解释》第六十四条企业法人解散的，依法清算并注销前，以该企业法人为当事人;未依法清算即被注销的，以该企业法人的股东、发起人或者出资人为当事人。
