释义	精神病人一般不能协议离婚。但如果是间歇性精神病人，在其神志清醒，能够完全辨认自己行为的时候是可以签订离婚协议，并且办理协议离婚。除此之外任何情况精神病人都不能办理协议离婚，即使签订了离婚协议，该协议也是无效的。法律依据: 《民法典》第一千零七十六条夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
