释义	法院对聚众哄抢罪既遂的裁判： 1、构成本罪既遂的，法院一般对其首要分子和积极参加者判处三年以下有期徒刑、拘役或管制，并处罚金； 2、犯罪数额达到巨大标准或情节特别严重的，则应判处三年以上十年以下有期徒刑，并处罚金。【法律依据】《刑法》第二百六十八条聚众哄抢公私财物，数额较大或者有其他严重情节的，对首要分子和积极参加的，处三年以下有期徒刑、拘役或者管制，并处罚金；数额巨大或者有其他特别严重情节的，处三年以上十年以下有期徒刑，并处罚金。
