释义	劳动争议当事人应当自知道或者应当知道其权利被侵害之日起1年内以书面形式向有管辖权的劳动人事争议仲裁委员会申请仲裁，并按照被申请人人数递交副本。法律对申请劳动仲裁时效有特别规定的按该特别规定计算。法律依据：《中华人民共和国劳动争议调解仲裁法》第四十九条有下列规定情形的，可自收到仲裁裁决书之日起30日内向劳动人事争议仲裁委员会所在地的中级人民法院申请撤销裁决。仲裁裁决被撤销的，当事人可自收到裁定书之日起15日内就该项劳动争议事项向有管辖权的基层人民法院起诉。
