法律分析：不是真的。立案后要向对方送达一般7日内向被告送达传票，现实生活中法院立案后多久能收到传票一般由法院掌握，一般情况下在10天到一个月内。 02 法院立案后应该先传唤被告，通知被告后才会通知原告，也就是说法院先是电话通知被告，如果通知不到采用直接送达、留置送达、委托送达、邮寄送达诉讼文书所不能送达的情况下，最后采用公告送达，公告送达是指采用登报的方式送达传票自发出公告之日起，经过六十日，即视为送达。
法律依据：《公安机关办理刑事案件程序规定》第一百七十八条 公安机关接受案件后，经审查，认为有犯罪事实需要追究刑事责任，且属于自己管辖的，经县级以上公安机关负责人批准，予以立案；认为没有犯罪事实，或者犯罪事实显著轻微不需要追究刑事责任，或者具有其他依法不追究刑事责任情形的，经县级以上公安机关负责人批准，不予立案。对有控告人的案件，决定不予立案的，公安机关应当制作不予立案通知书，并在三日以内送达控告人。决定不予立案后又发现新的事实或者证据，或者发现原认定事实错误，需要追究刑事责任的，应当及时立案处理。
