释义	合同到期未能履行不构成违约。原合同到期后，双方虽未约定到期自动续约，合同期限届满后，合同一方仍按原合同约定的标准继续履行义务，另一方认可并受领的，视为双方均认可按照原合同约定的标准继续履行义务是有效的。但此时并不能认为合同已自动续期，仅合同履行义务一方有权按照原合同约定的标准主张相应权利。法律依据：《民法典》第五百六十六条合同因违约解除的，解除权人可以请求违约方承担违约责任，但是当事人另有约定的除外。
