释义	法律分析：当事人被宣告死亡后还活着的，其婚姻关系的处理方式：当事人首先可以申请撤销死亡宣告，一旦其死亡宣告被撤销的，其在之前与配偶婚姻关系自撤销死亡宣告之日起自行恢复。但是，如果其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的，那么当事人的婚姻关系仍会处于消除状态，依法不予恢复。法律依据：《民法典》第五十一条被宣告死亡的人的婚姻关系，自死亡宣告之日起消除。死亡宣告被撤销的，婚姻关系自撤销死亡宣告之日起自行恢复。但是，其配偶再婚或者向婚姻登记机关书面声明不愿意恢复的除外。
