释义	不要戴的，被羁押的被告人在开庭时也要取下手铐的。法律依据：《中华人民共和国人民警察使用警械和武器条例》第八条人民警察依法执行下列任务，遇有违法犯罪分子可能脱逃、行凶、自杀、自伤或者有其他危险行为的，可以使用手铐、脚镣、警绳等约束性警械：（一）抓获违法犯罪分子或者犯罪重大嫌疑人的；（二）执行逮捕、拘留、看押、押解、审讯、拘传、强制传唤的；（三）法律、行政法规规定可以使用警械的其他情形。人民警察依照前款规定使用警械，不得故意造成人身伤害。
