释义	债权和债务同归于一人的，合同的权利义务终止，但涉及第三人利益的除外。因此，合同债权为第三人权利的标的，则债权不得因混同而消灭。如合同债权为他人质权的标的，则此合同债权不得因混同而消灭，否则有损于质权人的利益。此外，法律有例外规定的，债权不得因混同而消灭。法律依据《民法典》第五百七十六条
