释义	擅自转让国有档案罪的构成要件： 1、主体为具有刑事责任能力的自然人； 2、主观上是直接故意； 3、客体是国家对档案的管理制度； 4、客观上为违反档案法的规定，擅自出卖、转让国家所有的档案，情节严重的行为。【法律依据】《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第三百二十九条第二款违反档案法的规定，擅自出卖、转让国家所有的档案，情节严重的，处三年以下有期徒刑或者拘役。
