释义	法律分析：如果合同未签字，但是一方当事人已经实际履行了合同义务，同时对方当事人接受了履行的，此时合同生效。因为这种情况说明双方当事人对合同的内容存在着共识，意思表示一致。所以此时的合同应当是有效成立的。法律依据：《中华人民共和国民法典》第四百九十条法律、行政法规规定或者当事人约定采用书面形式订立合同，当事人未采用书面形式但一方已经履行主要义务，对方接受的，该合同成立。第四百九十条　采用合同书形式订立合同，在签字或者盖章之前，当事人一方已经履行主要义务，对方接受的，该合同成立。
