抚恤金再婚配偶能有吗

法律分析：
根据我国民法典规定，看具体情况来判定：
一、如果死者所在单位对抚恤金的给付对象有规定，则按规定处理。
二、如果死者所在单位没对给付对象作出规定，则应属于死者的直系亲属共有，再婚配偶也能分割该抚恤金。

《中华人民共和国民法典》第一千一百二十三条规定的：继承开始后，按照法定继承办理；有遗嘱的，按照遗嘱继承或者遗赠办理；有遗赠扶养协议的，按照协议办理。
